First hearing of private prosection by Lindis Percy - three summonsed at Towcester Magistrates' Court - 10 March 2008

In an unusual hearing and despite being summonsed to appear at Towcester Magistrates' Court to enter a plea, none of the Defendants were in court. Barry Awathes and Kenneth Woodhouse (Ministry of Defence Police Agency at the American base at Croughton) were apparently in the building but for some surprising reason, the Magistrates were content that they stayed outside the court while being represented by their Solicitor.There was no representation or questioning by the Magistrates as to why Frank Macdonald (First Airman USAF) did not appear.

The Crown Procesection Service had rung the court on Friday asking for an adjournment so that they could decide whether to take over this private prosecution or not. The case was adjourned until 31 March 2008.
