R v Lindis Percy
Appeal against convictions and sentences (including electronic tagging and curfew)
 
DAY 1
 
Lindis Percy was found guilty of five 'sample' cases out of 32 which were heard before Roy Anderson (District Judge) in May this year at Harrogate Magistrates' Court.  She was found guilty of all five cases and sentenced to be electronically tagged and curfewed in her home in Hull from 8 pm to 6 am for 8 weeks and ordered to pay £1,000 in costs.
 
Today's case was to appeal these convictions and sentences. Today the retrial started at York Crown Court when the Prosecution presented their case and Ministry of Defence Police Agency officers gave evidence.  Video evidence was shown of the regular peaceful Tuesday evening CAAB demonstration and the actions of Lindis and other demonstrators.  The court adjourned at 4.30 pm having heard three of the five charges. 
 
The fourth incident will be completed tomorrow after PC Bridges has had a chance to re-look at the CCTV video recording of the incident on 30 November 2005.  He mentioned at the end of his evidence that a car's wing mirror had 'hit' Lindis as it was exiting the base.  The Judge invited this officer to re-examine the video and point out to the court tomorrow where and when he thinks the alleged incident happened.
 
PC McMullen who gave evidence in the second incident has been flown back to the UK from Jordon especially to give evidence in this case.

The case resumes at 10.30 am on Thursday 17 November 2005.
