CAAB Report 173

Reports menu

Tuesday 26 July 2005

Since the court case in May this year, we have been at the entrance of NSA Menwith Hill each Tuesday evening from 6 - 8 pm. We reflect that there have been no arrests or problems since the case,  which contrasts starkly with the multiple arrests (Lindis) last year and up to May 2005. We have continued to protest peacefully and in the usual manner.  There were 13 demonstrators tonight.

Lindis Percy however was 'reported' by David Harding (Sergeant - Ministry of Defence Police Agency) for allegedly breaching her High Court injunction.  He refused to address any questions concerning the Military Land Byelaws at Menwith Hill, even though Lindis  should also have been in breach of the byelaws.

A 'yellow line' is painted on the ground and apparently is said to only 'indicate' the boundary (as ruled by District Roy Anderson). There is a 'red line' on a map of the byelaws and also Lindis has a map with the injunction area maked by a 'red line' which is said to show the boundary of Menwith Hill.

Later Lindis was issued with 'a section 69 notice' under the Criminal Justice and Public Order Act 1994 (not to trespass on MOD land witn three months at Menwith Hill under s.68 terms) by David Harding. Two other people present were also issued with the same notice.

Lindis was then arrested by David Harding for allegedly being in breach of the section 69 notice and taken to Harrogate Police Station where she was later charged. She is bailed to appear at Harrogate Magistrates' Court on 12 August at 10 am.
